Kelley and Scott Wolf’s divorce proceedings continue after Kelley completed a brief stint in rehab.
Kelley Wolf, 48, entered rehab following a Sept. 2 court appearance where she told the judge about her treatment plans. She exited the facility by Tuesday, Sept. 9.
The next day, she appeared in court without a lawyer, according to a source who spoke to PEOPLE. The judge refused to rule on any matters because Kelley didn’t have legal representation, even though Scott’s attorneys requested a full restraining order.
Current Legal Restrictions
The judge kept parts of the Aug. 28 protective order in place. Kelley still can’t have direct or indirect contact with Scott or their three children: Jackson, 16, Miller, 12, and Lucy, 11. She must stay at least 300 feet away from Scott.
But there’s one change. The judge now allows Kelley and Scott Wolf, 57, to communicate by phone because it’s best for the kids. Neither parent has to answer the other’s calls, especially if problems come up.
Their next divorce hearing is scheduled for Oct. 23. The judge told Kelley she needs to hire a lawyer before that date and ordered Scott to help pay for part of her legal fees.
Criminal Charges
Kelley faces three misdemeanor charges related to domestic violence during her divorce from Scott. The charges include electronic communications harassment and two counts of electronic disclosure of personal identifying information.
She was arrested on Aug. 26 on suspicion of electronic communication harassment and electronic disclosure of personal identifying information, the Summit County Sheriff’s Office confirmed.
The arrest came after days of confrontational social media posts where she allegedly shared personal information about friends and family members. One post included Scott’s personal phone number along with communications involving their three children.
Kelley’s social media activity violated the couple’s temporary agreement from Aug. 26. That agreement included a social media and press gag order preventing both parents from posting about each other, their marriage, their children, or their divorce.
Protective Order Details
On Aug. 28, Judge Richard Mrazik issued a new protective order. It prevents Kelley from having any direct or indirect contact with Scott or their children. She can only communicate with Scott during mediation sessions with a “Court Qualified Mediator” about their divorce or custody issues.
Scott was granted sole temporary custody of the children on Aug. 26 after Kelley was placed under an involuntary 5150 hold at a Utah hospital.
The 5150 hold happened after police detained Kelley while she was recording on Instagram Live on June 13.
The Instagram Live Incident
Kelley filmed police officers arriving and posted the video to her Instagram account. The clip showed officers detaining her while explaining their concerns.
“Made some comments to your dad and comments to people that are concerning, so they want to make sure you’re okay,”
one officer said in the video.
The officers told her she wasn’t going to jail and they wanted to get her help. Kelley responded:
“I know what I’m doing, I’ve done this. This is my job.”
Marriage Background
Scott and Kelley met in 2002 and married in 2004. They celebrated their 20th wedding anniversary in May 2024.
In June, Kelley announced their split on Instagram, calling Scott “one of the best fathers I’ve ever known and one of the best partners a woman could have the privilege of sharing life with.”
“He is kind, thoughtful, funny, and beautiful in spirit. We both look forward to an extraordinary life centered around the most extraordinary children. My priority has always been their wellbeing – and my own healing. That will never change,”
she wrote.
Scott called the split “the most difficult decision of my life” in his own statement. He said their children “have always been, and continue to be, the loves of our lives and our every priority” and asked for privacy as they help guide the kids through this transition.
