Denise Richards Files to Remove Aaron Phypers & Family from Home

According to documents obtained by PEOPLE, Denise Richards filed new court papers Tuesday asking a judge to force her estranged husband Aaron Phypers and his family out of her Calabasas home.

The actress says she needs to get her dogs and belongings before an eviction happens. She claims Phypers stopped paying rent.

Richards, 54, wants the court to order Phypers, 52, and his family to leave the property so she can retrieve her items without violating their temporary restraining order. Phypers currently lives there with his parents and brother.

Eviction Notice Triggers Court Filing

The Wild Things star says she moved out two years ago. She was told Phypers’ family would only stay temporarily.

Richards claims she told Phypers in January he’d be responsible for all rent payments. She says they promised “several times” to move out.

The landlord notified Richards on July 24 that eviction proceedings would begin August 23.

The filing states the landlord tried multiple times to contact Phypers about unpaid rent but couldn’t reach him.

“I left many of my personal items and my late mother’s items at the house based on Aaron telling me that his family would be moving back to Canada and we would be moving back into the [property]. If I am not able to [retrieve] my dogs and belongings, I believe my dogs will be harmed and my property destroyed or discarded during the eviction process.”

Home Allegedly Left in “State of Disarray”

The Real Housewives of Beverly Hills alum claims Phypers and his family damaged the home severely. She describes it as being in a “state of disarray.”

Evidence photos show removed flooring patches and boxes, clothing, and papers scattered throughout rooms.

“I was shocked at the condition of the home, having not lived there for over two years,” Richards wrote.

A source close to Phypers denies Richards’ allegations.

“She has kept all personal, business, and third-party equipment from Phypers, leaving him with only a shirt on his back for the last 50 days.”

The source calls the filing an attempt “to divert attention away from her adulterous affair.”

They claim Richards canceled a previously agreed property swap on July 16 when movers were “surprisingly turned away.”

Police Called to Property Earlier This Month

Richards references an August 3 incident when police were called to the Calabasas home.

Richards has a restraining order against Phypers amid domestic violence allegations.

Richards went to the house thinking Phypers wasn’t there. Her attorney said she wanted to “retrieve her dogs after learning that Mr. Phypers had put down one of her other dogs without her knowledge or permission.”

A source close to Phypers called this “100 percent, absolutely false.” They claim Richards was screaming and banging on the door to get inside.

Phypers told PEOPLE he euthanized the dog because it had cancer. He alleged “Denise hasn’t interacted with the animals in two years.”

Richards claims she only left the dogs there temporarily in May while getting surgery.

The Lost Hills Sheriff’s Department said they “did not have any evidence that a crime occurred.”

However, PEOPLE confirmed Phypers was on the property when Richards arrived.

New Details About August Incident

Richards offers her version of what happened that day.

“While I was attempting to leave the [property], Aaron’s brother blocked me from leaving and placed blocks under the tire[s] of my vehicle so that I could not move my car. Aaron’s mother let me in the house and then Aaron’s parents interfered with me trying to leave the [property]. Aaron’s mother called Aaron and told him to come back to the [property] while I was there, which would have been a violation of the TRO.”

Richards says she’s tried multiple times to resolve things without court intervention.

She claims she has “no way of retrieving my dogs and belongings in a safe manner” without a court order.

Richards also asks for “no recording or listening devices in or around” the property when she’s there.

Divorce Filed After Six Years of Marriage

Phypers filed for divorce from Richards in July following six years of marriage.

The following week, Richards claimed he “repeatedly abused” her throughout their relationship. Phypers has denied these allegations.

Richards made detailed abuse allegations in court documents, claiming Phypers would “frequently violently choke me, violently squeeze my head with both hands” and make threats.

She alleged he “has caused me at least three concussions.”

Phypers responded to the abuse claims directly.

“Let me be unequivocally clear: I have never physically or emotionally abused Denise – or anyone. These accusations are completely false and deeply hurtful. Denise and I, like many couples, have faced our share of challenges, but any suggestion of abuse is categorically untrue.”
